These Terms and Conditions ("Terms") govern your use of the BillWater website (the "Site"), the BillWater mobile application (the "App"), and any services provided by BillWater ("we," "us," or "our"), owned by Civenture Engineering Solutions. By accessing or using the Site, the App, or any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Site, the App, or our services.

1. Use of the Site and the App

a. Eligibility:

• You must be at least 18 years old and capable of entering into a legally binding agreement to use the Site, the App, and our services. By accessing or using the Site, the App, or our services, you represent and warrant that you meet these eligibility requirements.

b. License:

• Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Site and the App for your personal use.

• Violates any applicable laws, regulations, or third-party rights.

• In order to access certain features of the Site, the App, or our services, you may be required to register for an account.

• You are responsible for maintaining the security of your account credentials and for any activities that occur under your account.

• You agree to notify us immediately if you become aware of any unauthorized use of your account or any other breach of security.

3. Payment Terms

a. Payment Processing:

• Payment processing services for the Site and the App are provided by third-party payment gateway partners. We do not store or process payment information on our servers.

• By making payments through the Site or the App, you agree to be bound by the terms and conditions of our third-party payment gateway partners.

b. Fees and Charges:

• You are responsible for all fees and charges associated with your use of the Site, the App, and our services, including any applicable taxes.

c. Pricing:

• The Water Supply schemes have to pay an amount of 500Rs to 20000Rs per scheme as annual fee for availing the Software service, Online Payment Service. The pricing will be decided by considering the number of consumers in the scheme.

4. Intellectual Property

a. Ownership:

• All content and materials available on the Site, the App, and our services, including text, graphics, logos, images, and software, are the property of Civenture Engineering Solutions or its licensors and are protected by copyright, trademark, and other intellectual property laws.

b. License to User Content:

• By submitting or posting any content on the Site or the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.

5. Disclaimer of Warranties

a. As-Is Basis:

• The Site, the App, and our services are provided on an "as-is" and "as available" basis, without any warranties of any kind, express or implied.

• We do not warrant that the Site, the App, or our services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

6. Limitation of Liability

a. Exclusion of Damages:

• In no event shall Civenture Engineering Solutions or its affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or in connection with your use of the Site, the App, or our services.

a. Indemnity:

• You agree to indemnify, defend, and hold harmless Civenture Engineering Solutions and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the Site, the App, or our services.

8. Governing Law and Dispute Resolution

a. Governing Law:

• These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

b. Dispute Resolution:

• Any dispute arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, and the seat of arbitration shall be Irinjalakuda in Thrissur District.

We reserve the right to update or modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Site and the App. Your continued use of the Site, the App, or our services after any such changes constitutes your acceptance of the updated Terms.
